Terms of Service

1. Acceptance of Terms

By accessing or using Biltry, you agree to be bound by these Terms of Service and all policies incorporated herein, including our Privacy Policy. If you do not agree to these terms in their entirety, you may not use the platform. Your continued use of Biltry following any modification to these terms constitutes your acceptance of the updated terms.

2. Eligibility

You must be at least 18 years of age to create an account or purchase a report on Biltry. By using the platform, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding agreement. Biltry LLC reserves the right to terminate any account found to belong to a person under 18.

3. Use of the Platform

Biltry is intended for lawful use only. You may not use the platform to submit false, defamatory, misleading, or fraudulent information. You may not use automated tools, bots, scrapers, or scripts to bulk-access, scrape, or download data from Biltry without prior written permission. You may not resell, sublicense, or commercially redistribute improvement records or report content obtained from Biltry. Any use of the platform for illegal purposes — including but not limited to fraud, harassment, or violation of third-party privacy rights — is strictly prohibited.

4. Accuracy of Submitted Information

By submitting any improvement record, you attest that the information provided is accurate, truthful, and supported by the evidence you upload. You further represent that you have the right to submit any documents you upload, and that doing so does not violate the privacy rights or intellectual property rights of any third party (including contractors, vendors, or service providers whose information may appear on receipts or invoices). Submitting falsified records, fabricated receipts, or misleading information is a material violation of these Terms and will result in immediate account termination and potential legal action.

5. Report Purchases — License & Restrictions

When you purchase a full improvement report for an address, Biltry LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and view that report for your own personal, informational, or professional due-diligence purposes. You may not: (a) resell, redistribute, or publicly republish report content; (b) use report content to build a competing database or data product; (c) share purchased reports with third parties for commercial purposes; or (d) use report content in any manner that violates applicable privacy laws or the rights of individuals whose information appears in the report. Biltry LLC reserves the right to revoke report access for any purchaser found to be misusing report content.

6. All Sales Are Final

All report purchases made on Biltry are final and non-refundable. By completing a purchase, you acknowledge that you have reviewed the available preview information for the address and agree that no refunds will be issued under any circumstances, including dissatisfaction with the quantity of records, content of reports, or change of mind. The sole exception is a verified technical failure by Biltry LLC that prevents report delivery, which will be addressed at Biltry LLC's sole discretion.

7. Aggregate Data & Statistical Products

Biltry LLC may compile, analyze, and license aggregated, de-identified datasets derived from platform activity — including renovation trends, average improvement costs by region or zip code, improvement frequency by category, and other market analytics. This data does not identify individual users, accounts, or specific property owners. By using the platform and submitting content, you grant Biltry LLC the right to include your de-identified, aggregated data contributions in such datasets and to sell or license those datasets to third parties. No individual records, uploaded documents, personal identifying information, or account details are included in these datasets.

Biltry LLC does not sell, share, rent, or disclose your personal information, uploaded documents, verification documents, or individual improvement records to any third party for commercial purposes. Ever. The only data Biltry LLC may license to third parties is fully anonymized aggregate statistics that cannot be traced back to any individual user, account, or property owner.

8. Organizational & Business Access

Biltry LLC may offer bulk report access, API access, or data licensing arrangements to organizations such as real estate brokerages, title companies, lenders, insurance companies, and similar entities. Organizational purchasers are subject to these Terms of Service and any additional agreement executed with Biltry LLC. Organizational purchasers may not use report content to build competing databases, may not resell individual reports, and must comply with all applicable privacy laws governing the data they access. Biltry LLC is not responsible for how organizational purchasers use report content beyond the restrictions set forth herein.

9. Intellectual Property & Data Ownership

Biltry LLC owns all rights to the platform, its design, software, and the aggregated database of improvement records compiled through the service. By submitting content to Biltry, you grant Biltry LLC a perpetual, irrevocable, worldwide, royalty-free license to use, store, display, analyze, and distribute that content in connection with operating the platform, providing reports to paying purchasers, and conducting the business activities described in these Terms and our Privacy Policy. You retain ownership of original content you submit, subject to this license.

10. Third-Party Services & AI Processing

Biltry LLC uses third-party services to operate the platform, including Stripe for payments, Mapbox for address lookup, Supabase for data storage, Resend for email, Anthropic for AI-powered document validation, and Vercel for hosting and deployment. When you upload a document, it is transmitted to Anthropic's API for automated review. Biltry LLC is not responsible for the data practices of these third-party providers. By using the platform, you consent to the processing of your data by these services as necessary to deliver Biltry's functionality.

11. Account Suspension & Termination

Biltry LLC reserves the right, at its sole discretion, to suspend or permanently terminate any account that: (a) submits false or misleading improvement records; (b) uploads fraudulent or fabricated documents; (c) engages in abusive, harassing, or disruptive behavior toward other users or Biltry LLC staff; (d) violates any provision of these Terms; (e) misuses purchased report content; or (f) is otherwise determined to be harmful to the platform, its users, or third parties. Termination may occur without prior notice. Biltry LLC is not liable for any loss or damage resulting from account suspension or termination.

12. Disclaimer of Warranties

Biltry LLC provides all information on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the accuracy, completeness, or timeliness of any record, report, or other content on the platform. Improvement records are submitted by users and have not been independently verified by Biltry LLC beyond automated document review. Users should independently verify all material information before making purchasing, selling, leasing, lending, or investment decisions related to real property.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Biltry LLC, its owners, officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of or inability to use the platform, including any reliance on records, reports, AI-generated validation results, or other content. This includes but is not limited to losses arising from real estate transactions, property valuations, or decisions made based on Biltry report content. Biltry LLC's total cumulative liability to you for any claim arising out of or relating to these Terms or the platform shall not exceed the greater of (a) the total amount you paid to Biltry LLC in the twelve months preceding the claim, or (b) fifty dollars ($50.00).

14. Indemnification

You agree to indemnify, defend, and hold harmless Biltry LLC and its owners, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the platform; (b) content you submit, including any claim that your submitted content violates the rights of a third party; (c) your violation of these Terms; or (d) your violation of any applicable law or regulation.

15. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of Biltry shall be resolved exclusively through binding individual arbitration administered under the rules of the American Arbitration Association (AAA), and not in court. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST BILTRY LLC. By using the platform, you agree that all claims must be brought in your individual capacity only. This arbitration agreement is governed by the Federal Arbitration Act. Nothing in this section prevents either party from seeking injunctive or other equitable relief in court to prevent irreparable harm pending arbitration.

16. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Michigan, without regard to conflict of law principles. To the extent any claim is not subject to arbitration, you consent to exclusive jurisdiction and venue in the state or federal courts located in Michigan.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions shall continue in full force and effect.

18. Changes to Terms

We may update these Terms of Service at any time. Changes take effect immediately upon posting to the platform. Continued use of Biltry after any changes constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify registered users of material changes via email or a platform notice.
